Deregulation proposals – new thresholds for the application of the Public Procurement Law and the Act on Concession Contracts for Construction Works or Services.
On 30 April 2025, a draft bill amending the Public Procurement Law and the Act on Concession Agreements for Construction Works or Services was published on the RCL website.
The key legislative proposals included in the draft are to raise the statutory threshold for the application of the Public Procurement Law and the Act on Concession Contracts for Construction Works or Services from the current PLN 130,000 to PLN 170,000.
The proposed changes are part of the so-called deregulation package, which aims to reduce the formalisation of public procurement and concession agreements for construction works. The draft responds to long-standing demands and the need to respond to price increases on the market.
According to the justification for the proposed provisions, the increase in the thresholds for the application of the above-mentioned acts is not only intended to adapt them to changing economic realities, but also to ensure flexibility and adequacy in the method of selecting contractors and the procedure for concluding public procurement contracts or concession contracts for construction works or services.
It is worth noting that the current threshold for the application of the Public Procurement Law has not been indexed since the current version came into force in 2021.
