Higher fees in proceedings before administrative courts?
On 18 July 2025, the Government Legislation Centre published a draft regulation of the Council of Ministers on the amount and detailed rules for collecting fees in proceedings before administrative courts for consultation and agreement. The draft contains a number of changes concerning an increase in the amount of fees in cases before administrative courts. According to the justification for the proposed changes, they are necessary, among other things, due to the fact that the rates of fees in proceedings before administrative courts have not been indexed since 2004, unlike the regulations covering fees in civil proceedings.
The proposed changes concern not only an increase in court fees, but also result from the need to update and organise the matter of court fees in proceedings before administrative courts in connection with the need to adapt court fees to changes that have taken place in the legal situation and socio-economic life over the last 20 years. In accordance with the legislator's objective, the new provisions should be more transparent and remove any doubts as to the interpretation of the basis for court fees. Some of the changes result from an analysis of the case law of administrative courts in the context of the problematic interpretation of certain concepts, but also from changes in other legal provisions that affect the issue of entries in proceedings before administrative courts, given the jurisdiction of these courts.
The explanatory memorandum to the draft regulation presents a tabular comparison of the current fees and those proposed by the legislator.
For example, currently, in cases of complaints concerning licences or permits to conduct business activity in the field of production and wholesale trade in pharmaceuticals, a fixed fee of PLN 3,000 applies, while after the amendment it will be double that amount, i.e. PLN 6,000. Similarly, in cases concerning customs law, according to the proposed changes, the fee will double (currently PLN 5,000) to PLN 10,000.
The minimum rate will also increase, among other things, at the first threshold of the proportional entry fee, which currently amounts to 4% of the value of the monetary claim covered by the contested act, but not less than PLN 100, for disputes with a value of up to PLN 10,000. After the changes, this threshold will still be 4%, but not less than PLN 200. The fee for complaints against the inaction of public administration bodies, which currently amounts to PLN 100, will also double. After the changes to the regulation, complaints against the inaction of public administration bodies or the chronic conduct of proceedings will require a fee of PLN 200.
