The President of Poland vetoed the amendment to the Act on the provision of electronic services dated December 18, 2025.

President Karol Nawrocki vetoed the amendment to the Act on the provision of electronic services of 18 December 2025, which was intended to implement the EU Digital Services Act (DSA) into Polish law.
What was this law supposed to change?
 

- The main goal was to increase online security and protect users' rights against the dominance of digital giants. The law provided for, among other things:
- A procedure for blocking illegal content on online platforms, based on a decision by the President of UKE or KRRiT. The control was to be activated in the event of the publication of materials concerning, among other things: criminal threats, incitement to commit suicide, sexual abuse of minors, promotion of totalitarian ideologies, and incitement to hatred and insults based on nationality, ethnic origin, race or religion.
 

- The possibility to appeal against a decision to block content, which would be submitted directly to the court within 14 days of its delivery.
- Establishment of rights for users through the obligation for platforms to justify the blocking of an account or entry and a clear appeal process.
- Supervision of platforms guaranteed by the appointment of the President of UKE as the Digital Services Coordinator and the appointment of trusted reporting entities and certified researchers.
Why did the President veto the bill?
 

Despite amendments introduced in the Senate to strengthen judicial oversight, the President considered the provisions to be a threat to freedom of speech. He argued that they create a system based on ‘administrative censorship’, in which the 14-day deadline for filing an objection with the court is too short.
What next?
 

lthough the EU's DSA regulation is directly applicable, Poland still lacks the national procedures and authorities to fully enforce it.
The president has called for a new draft to be prepared within a month
and has invited the Ministry of Digital Affairs and civil society organisations to cooperate. However, the Ministry of Digital Affairs warns that the veto weakens the position of citizens in their confrontation with platform algorithms.
