Unfair dismissal of an employee – legal commentary
A court battle for reputation – legal commentary by Dariusz Tarabasz, attorney-at-law. In a TVP Kielce report, Dariusz Tarabasz, partner at the Law Firm, gave an interview.
Attorney Dariusz Tarabasz represented the claimant in a dispute with her employer (a museum of significant local importance). The claimant worked as an accountant (a position requiring special trust). The dispute centred on her unlawful disciplinary dismissal and her right to return to work. The case was heard twice by the Supreme Court, where, in accordance with the motion filed by Dariusz Tarabasz, the Supreme Court overturned the unfavourable judgments of the Regional Court in Kielce.
Furthermore, the Supreme Court agreed with our solicitor's arguments and referred the case to the Regional Court in Krakow, which legally reinstated the claimant to her job. However, there is more to this story. The Regional Court in Kielce must now decide on the remuneration for the remaining period of the claimant's unemployment (9 years).
The Supreme Court's rulings in this case touch upon the essence of special protection for employees and are of great importance for pregnant women and people approaching retirement age. It is also a story of fighting for one's good name and reputation.
