The Government plans to amend the Industrial Property Law

Information on proposed amendment of the Industrial Property Law was published in the Public Information Bulletin of the Council of Ministers on October 10, 2017.

The aim of the proposed act is to improve and shorten proceedings before the Polish Patent Office, eliminate the interpretative doubts arising from the application of some provisions of the Act, as well as to ensure full compliance of the Act with the provisions of the European Patent Convention and other acts of international law.

The draft shall provide for provisions on acceleration of the adjudication proceedings, waiving the requirement of written reasons for the decision drawn up ex officio and supporting entrepreneurs at the initial stage of business activity. In particular, the proposed act shall contain the exemption from the fees for the first period of protection (in case of industrial designs and trademarks). The project shall specify the definition of invention and requirement of unity of invention.
