Pharmacy can not be punished for use of the name containing advertising slogans.
If the pharmaceutical inspection accepts the name of the pharmacy in the operating license, therefore there is no reason to punish the company for use of such name until withdrawn the operating license from the market – said The Province Administrative Court in Warsaw.
The case concerns placement of the inscriptions containing text: "PHARMACY (...) WHOLESALE PRICES" which was the name of the pharmacy under the operating license, on the pharmacy storefront.
The Province Administrative Court found that the phrase "Wholesale Prices" was in fact a pharmacy advertising, however it can not be analyzed and investigated in isolation from the facts that the name of the pharmacy was previously accepted by the authority in the operating license.
The court pointed out that it is not acceptable in a democratic state of law that the authority by one decision accepts the name of the pharmacy and sees no contradiction with the provisions of the pharmaceutical law and by another decision – due to the use of the name previously approved – recognized that it is incompatible with the provisions of this Act.
