The Court of Justice annulled the Commission Decision concerning the protection provided by the “safe harbour” privacy principles.
The Court of Justice annulled the Commission Decision (2000/520/EC) concerning the protection provided by the “safe harbour” privacy principles. Pursuant to decision mentioned aboved, the national supervisory authorities were not entitled to control the conditions under which the personal data of EU citizens were transferred to administrators from the United States.
The Tribunal found that the Commission was not entitled to limit the powers of the national supervisory authorities. Therefore, the national supervisory authorities may prohibit the transfer of personal data to the US. The judgment accords with previous opinion of the Advocate General of CJEU.
