The General Court: You can register three-dimensional shape of the Lego figures as a trademark

On 16 June 2015 r. The General Court gave a judgment in Cases T-395/14 and T-396/14 Best Lock (Europe) Ltd v OHIM - Lego Juris. The judgment concerns the possibility of registration of a three-dimensional shape of Lego figure as a Community trade mark. According to Council Regulation No 207/2009 on the Community trade mark, it shall not be allowed to register signs which consist exclusively of the shape which results from the nature of the goods themselves or which consist exclusively of the shape of goods which is necessary to obtain a technical result.

The General Court held that Lego figures does not satisfy the above negative conditions, and therefore there are no grounds for cancellation of registration of such dimensional trademarks.
